Terms for creating and using images

By accessing or using PhotoGenerAI, you agree to these Terms, our Privacy Policy, and our Acceptable Use Policy. If you do not agree, do not use the service. You must be at least 18 years old and legally able to enter this agreement.

PhotoGenerAI creates images from text prompts and edits uploaded photos using your instructions and optional reference images. We may change, suspend, limit, or discontinue any part of the service. We do not guarantee that the service or any result will always be available, accurate, unique, or unchanged.

Some parts of the service may allow or require an account. You are responsible for providing accurate account information, protecting your sign-in method, and telling us promptly about unauthorized use. You may not use another person's account without permission.

PhotoGenerAI offers one-time credit packs. There is no subscription, automatic renewal, or automatic recharge. Prices and credit amounts appear on the pricing page. A third-party merchant of record handles checkout. The checkout identifies the seller and shows the total, including any applicable taxes, before you pay.

Each generation uses one credit. Free credits are used first. Purchased credits never expire. If a generation fails, we return its credit. Credits are for use within PhotoGenerAI and cannot be transferred or exchanged for cash except through an eligible refund.

You keep your rights in the photos, prompts, reference materials, and other content you submit. You must have the rights and permissions needed to use that content and to let us process it.

You give PhotoGenerAI and its service providers a limited license to host, copy, transmit, modify, and process your inputs only as needed to provide, secure, maintain, and enforce the service.

To the extent permitted by law, PhotoGenerAI does not claim ownership of the generated result returned to you. You may use a result for personal or commercial purposes, subject to these Terms, applicable law, and any rights in the materials you supplied.

AI systems can produce similar results for different people and can reproduce or alter details unexpectedly. We do not guarantee that a result is unique, copyrightable, accurate, or free of third-party rights. You are responsible for reviewing a result before publishing, selling, or relying on it.

Generated images can contain invented or inaccurate details. They are not evidence of real events, a guarantee of appearance or product performance, technical specifications, or professional advice.

Before publishing, selling, or relying on an image, review its details, the rights and permissions involved, and any claims you make about it. Verify product features, dimensions, and safety requirements independently where relevant. You are responsible for decisions and work based on a result.

You may not misuse the service, interfere with its operation, evade safeguards or limits, or submit or generate content prohibited by the Acceptable Use Policy. We may remove content, restrict access, suspend accounts, or preserve and report information when reasonably needed to address misuse, protect people or the service, or comply with law.

The service relies on third-party providers for hosting, authentication, AI generation, payments, security, and analytics. Their availability and processing can affect PhotoGenerAI. References or links to third-party products do not imply endorsement or partnership.

The service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing or usage of trade. Nothing in these Terms excludes a warranty or right that cannot legally be excluded.

To the fullest extent permitted by law, PhotoGenerAI and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from the service.

Our total liability for claims relating to the service will not exceed the greater of US$100 or the amount you paid us for the service during the six months before the event giving rise to the claim. These limits apply only where permitted by law.

We may update these Terms. The effective date at the top identifies the current version. Continued use after an update means you accept the revised Terms. Questions can be sent to support@photogenerai.com.
